This Agreement shall be governed by and construed in accordance with the laws of the Province of Ontario and Canada, without giving effect to any principles of conflicts of law. The site originates and is operated by Comoldco within Canada; therefore, Comoldco makes no representation that the site is appropriate or available for use in other locations. Any notices to be given under this Agreement shall be made by registered mail, fax or email. Faxes and emails shall be deemed received when actually received and notices by registered mail shall be deemed received five (5) days after they are mailed. No waiver of any breach of any term or condition contained herein by either party shall be deemed to be a waiver of breaches of any other term or condition contained herein, nor a continuing waiver in respect of future breaches of the same of any other term or condition contained herein.
Sections 5 and 6 survive any termination or expiration of this Agreement.
